1. Introduction
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "the user") and VoltaServices Limited ("we", "us", "our"), governing your access to and use of the VoltaAI platform, including the website, API, chat interface, and all related services.
By creating an account or using any part of the VoltaAI platform, you agree to be bound by these Terms in their entirety. If you do not agree with any provision of these Terms, you must not access or use our services.
2. Account Terms
To access certain features of the VoltaAI platform, you must create an account. By creating an account, you agree to the following:
- Age Requirement: You must be at least 16 years of age to create an account and use our services. By registering, you represent and warrant that you meet this age requirement.
- Accurate Information: You must provide accurate, current, and complete information during the registration process and keep your account information updated at all times.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials, including your password and API keys. You are fully responsible for all activities that occur under your account.
- One Account Per Person: Each individual may only maintain one account on the platform. Creating multiple accounts to circumvent restrictions, abuse free tier limits, or for any other purpose is strictly prohibited and may result in the termination of all associated accounts.
3. Acceptable Use
You agree to use the VoltaAI platform in a lawful and respectful manner. The following activities are expressly prohibited:
- Illegal Content: You must not use the platform to generate, distribute, or store any content that is unlawful, harmful, threatening, defamatory, obscene, or otherwise objectionable under the laws of England and Wales or any applicable jurisdiction.
- Abuse and Harassment: You must not use the platform to harass, bully, intimidate, or threaten any individual or group, or to generate content intended for such purposes.
- Automated Scraping: You must not use automated tools, bots, or scripts to scrape, crawl, or extract data from the platform beyond what is available through our documented API endpoints.
- Reselling API Access: You must not resell, sublicense, or redistribute access to the VoltaAI API or any services provided through the platform without prior written permission from VoltaServices Limited.
- Circumventing Rate Limits: You must not attempt to circumvent, bypass, or manipulate rate limits, usage quotas, or any other technical restrictions imposed on your account.
- Email Misuse: If you connect an email account through the AI Email Management feature, you must not use the platform to send spam, phishing emails, bulk unsolicited messages, or any communication that violates applicable anti-spam laws (including the Privacy and Electronic Communications Regulations 2003 and CAN-SPAM Act). You must not use the AI classification feature to circumvent email filtering or security measures of any third party.
4. Subscription Plans
VoltaAI offers the following subscription tiers, each providing different levels of access to models and usage limits:
- Free Tier: Available at no cost. Provides access to basic text and image models with daily usage limits of 100 messages and 10 images.
- Pro Tier (£5/month): Provides access to additional text models and enhanced image generation capabilities with increased daily limits.
- Premium Tier (£10/month): Includes all Pro features with significantly higher daily usage limits (3x Pro limits).
- Ultimate Tier (£15/month): Includes all Premium features plus access to exclusive models with the highest usage limits.
All subscription plans are billed monthly. You may cancel your subscription at any time through your account settings. Upon cancellation, your access to the subscribed tier continues until the end of the current billing period, after which your account reverts to the Free tier.
5. API Usage and Wallet
In addition to tier-based chat access, VoltaAI provides programmatic API access through a pay-as-you-go wallet system:
- Wallet Top-Up: API access is funded through wallet top-ups with a minimum amount of £10. Wallet funds are used to pay for API requests at published per-request rates.
- Pay-As-You-Go Pricing: Each API request is charged based on the model used and the number of tokens processed. Current pricing is displayed on the API Pricing page and may be updated from time to time.
- Balance Policy: Wallet balances never expire and remain available for use indefinitely, subject to account standing.
- Model Access: All models listed in the model registry are available via the API regardless of your subscription tier, provided you have sufficient wallet balance.
6. AI Email Management
VoltaAI offers an AI-powered email management feature that allows eligible users (Premium tier and above) to connect a Microsoft email account and benefit from AI-driven classification, organisation, and productivity tools. By connecting your email account, you agree to the following:
- Microsoft Account Connection: The AI Email Management feature requires you to authorise VoltaAI to access your Microsoft email account via Microsoft's OAuth 2.0 authentication flow. By connecting your account, you grant VoltaAI permission to read, send, and manage emails on your behalf using the Microsoft Graph API. You may revoke this access at any time by disconnecting your account from the VoltaAI email settings.
- AI Classification: When you connect your email account, VoltaAI will scan and classify your emails into organisational pathways (e.g., Important, Newsletters, Social, Finance, Shopping, Notifications) using AI language models. Email subject lines, sender information, and limited body content are processed by our AI providers to generate these classifications. Classification results are stored on our servers and associated with your account.
- Email Content Processing: To provide AI-powered features such as classification, smart search, and contextual suggestions, portions of your email content (including subject lines, sender addresses, and message excerpts) are transmitted to our AI model providers for processing. This data is processed in real time and is not retained by our AI providers beyond the duration of the request.
- Tier Restriction: AI Email Management is available exclusively to users on the Premium tier or above. If your subscription is downgraded below Premium, access to the email management feature will be suspended, though your previously classified data will be retained for up to 90 days in case you resubscribe.
- Your Responsibility: You are solely responsible for the content of emails you compose and send through the VoltaAI platform. VoltaAI does not monitor or moderate the content of outgoing emails, and you must ensure that your use of the email feature complies with all applicable laws and regulations.
- No Warranty on Classification: AI-driven email classification is provided on a best-effort basis. We make no guarantees regarding the accuracy or completeness of email classifications. Important emails may occasionally be miscategorised, and you should not rely solely on AI classification for critical communications.
7. Content and Intellectual Property
The following terms govern the ownership and use of content generated through the VoltaAI platform:
- User-Generated Content: You retain full ownership of any content that you generate through the VoltaAI platform, including text outputs and generated images. VoltaAI does not claim any ownership rights over your generated content.
- Platform Content: All intellectual property rights in the VoltaAI platform, including its design, code, branding, and documentation, are owned by VoltaServices Limited and are protected by applicable intellectual property laws.
- Anonymised Data: We may use anonymised and aggregated usage data to analyse trends, improve our services, and develop new features. Such data will not identify you personally.
8. Service Availability
We strive to provide a reliable and consistently available service, but certain limitations apply:
- Best-Effort Uptime: We endeavour to maintain high availability of the VoltaAI platform. However, we do not guarantee any specific uptime percentage, particularly for the Free tier.
- Scheduled Maintenance: We may perform scheduled maintenance that temporarily affects service availability. We will make reasonable efforts to communicate planned maintenance windows in advance.
- Third-Party Dependencies: The availability of specific AI models depends on the upstream model providers. We cannot guarantee the availability of any particular model at any given time.
9. Rate Limits and Fair Use
To ensure fair access for all users and to maintain platform stability, rate limits and fair use policies apply:
- Rate Limits: All accounts are subject to per-minute and per-day rate limits on API requests. These limits vary based on your subscription tier and API key configuration.
- Tier-Based Limits: Daily usage limits for models accessed through the chat interface are determined by your subscription tier. Specific limits for each tier are displayed on the Subscriptions page.
- Throttling: Excessive or abusive usage patterns may result in temporary throttling of your account to protect the platform and other users. We reserve the right to adjust rate limits at our discretion.
10. Termination
Either party may terminate the relationship under the following conditions:
- Termination by Us: We reserve the right to suspend or terminate your account immediately and without notice if you violate any provision of these Terms, engage in fraudulent activity, or pose a threat to the security or integrity of the platform.
- Termination by You: You may delete your account at any time through your account settings or by contacting our support team. Upon deletion, your access to the platform will be revoked immediately.
- Data Deletion: Following account termination, we will delete your personal data within 30 days, except where retention is required by law or for legitimate business purposes such as fraud prevention.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- "As Is" Basis: The VoltaAI platform and all related services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.
- AI-Generated Content: We make no representations or warranties regarding the accuracy, completeness, reliability, or suitability of any content generated by AI models through our platform. You use AI-generated content entirely at your own risk.
- Liability Cap: Our total aggregate liability to you for any claims arising out of or related to your use of the platform shall not exceed the total fees you have paid to us in the 12 months immediately preceding the event giving rise to the claim.
- Exclusion of Consequential Damages: In no event shall VoltaServices Limited be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will provide you with at least 30 days' prior notice by email or by posting a prominent notice on the platform before the updated Terms take effect.
Your continued use of the VoltaAI platform after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the platform and close your account.
